SEE HERE  I've dealt with the IRS and this kind of thing is pretty routine.  They really don't know what they are doing.  I remember reading a study that was done by presenting a wide variety of IRS offices the same question and getting back a huge variety of answers all different.  But if you don't think that government regulations hamstring small business especially then you should read this because it's a typical example.
